Efficiency Audits of the Division of Workers' Compensation and the Office of Injured Employee Counsel within the Department of Insurance

October 2026

The State Auditor's Office contracted with Weaver to conduct efficiency audits of the Division of Workers' Compensation and the Office of Injured Employee Counsel, in accordance with Texas Government Code, Chapter 327. These audits are being reported together to align with the most recent Sunset Commission report.

  • The Division of Workers' Compensation. Weaver identified inefficiencies in the Division's processes regarding medical fee disputes, hearings docketing, and fraud case management.
  • The Office of Injured Employee Counsel. Weaver identified inefficiencies in the Office's case management process.

Weaver did not identify any duplication, overlap, or conflict with other state agencies or misalignment between the Division's or the Office's rules in the Texas Administrative Code and their statutory authority and mission.

Both entities agreed to implement Weaver's recommendations and provided implementation plans, which are presented in the report.
